Monash Parking Overlay Deleted - Amendment C137

Amendment C137 to the Monash Planning Scheme, implemented 24 May 2018, has deleted the Parking Overlay and associated Schedules 1 and 2.

The purpose of the overlay and its schedules was to provide cash-in-lieu payments for car parking provisions in the Glen Waverley Principal Activity Centre Area and the Oakleigh Major Activity Centre Area. It is understood that sufficient funds have been collected for the planned off-street parking facilities and as such the cash in lieu systems of Schedules 1 and 2 of Clause 45.09 (Parking Overlay) have been rendered redundant.

Greater Flexibility

Pertinent to Schedules 1 and 2, a permit could previously not be granted to reduce the car parking requirement of any use, except dwelling, on the basis of the availability of car parking or public transport in the locality, reduction of car parking demand, any empirical assessment or any other relevant consideration.

With the deletion of the Parking Overlay, variations to the statutory requirement for the provision of car parking as defined in Clause 52.06 (Car Parking) may now be sought with the support of a suitably qualified Traffic Engineer. This provides greater flexibility according to the nature of a development and better ensures an appropriate number of car parking spaces is provided to a site with regard to the likely demand to be generated, the activities on the land and the locality.

Parking Rates for Specific Uses Reverted Back to Default

Also included within each of the schedules were defined car parking rates for specific land uses; Beauty Salon/Hairdresser, Restaurant, and Shop. With the removal of Schedule 1 and 2, parking rates for the above land uses will now revert back to default parking rates defined in Clause 52.06 (Car Parking), unless otherwise specified by planning controls of a specific site.

The parking requirement for each affected land use in the area of the Glen Waverley Principal Activity Centre will be as follows:

  • Restaurant – parking requirement to decrease by approximately 10% (now a rate of 0.4 spaces to each patron permitted pertinent to Clause 52.06, previously 0.45 to each seat available to the public pertinent to PO1),
  • Shop – parking requirements unchanged (4 spaces to each per 100sqm of leasable floor area),
  • Hairdresser is now considered to have a parking rate consistent with a Shop use, as outlined in Clause 75 (Nesting Diagrams), Now subject to a rate of 4 spaces to each per 100sqm of leasable floor area pertinent to 52.06, previously 6 to each per 100sqm of leasable floor area pertinent to PO1.

The parking requirement for each affected land use in the area of the Oakleigh Major Activity Centre will be as follows:

  • Restaurant – parking requirement to increase by approximately 30% (now a rate of 0.4 spaces to each patron permitted pertinent to Clause 52.06, previously 0.31 to each seat available to the public pertinent to PO2),
  • Shop – parking requirements increase by approximately 30% (now a rate of 4 spaces to each per 100sqm of leasable floor area, previously 3.1 to each per 100sqm of leasable floor area pertinent to PO2),
  • Hairdresser is now considered to have a parking rate consistent with a Shop use, as outlined in Clause 75 (Nesting Diagrams). Now subject to a rate of 4 spaces to each per 100sqm of leasable floor area pertinent to 52.06, previously 1 to each per 100sqm of leasable floor area pertinent to PO2.

Planned Off-street Parking Facilities

Schedule 1 to Clause 45.09 of the Monash Planning Scheme implemented the Parking Precinct Plan of the Glen Waverley Principal Activity Centre Area, which required cash in lieu contributions to fund part of the cost of car spaces within the new multi-deck car park in Euneva Avenue. The Parking Precinct Plan has been fully subscribed and the car park constructed.

Schedule 2 was put in place to fund the development of a multi-deck car park and providing additional car spaces in two locations; 2-6 Palmerston Grove and 129-133 Atkinson Street, Oakleigh, in response to the Parking Precinct Plan for the Oakleigh Activity Centre. The Parking Precinct Plan is now fully subscribed and now complete.
