Ratio’s urban design and planning units recently worked with a property lawyer to amend an existing covenant on a Toorak property, allowing our client to increase the development potential of their land.
The covenant restricted the height of any future development to single storey, below what would be permissible through the planning controls that apply to the site.
The beneficiary (being the neighbouring property) was concerned that removal of the covenant would allow for development that would impact their amenity. Our urban design team were able to put together comprehensive massing plans and 3D to demonstrate to all parties how additional height could be achieved without compromising neighbouring amenity.
Our multi-disciplinary approach gave us an appreciation for the planning, architectural and urban design factors involved and we were ultimately able to secure a building envelope arrangement which will allow for the development of two x two storey townhouses of over 300sqm each (over 600sqm in total) – a significant improvement over the previous development potential which was estimated to be in the order of 375sqm.
